Description

The author holds that the primacy program has been taken hostage by the Congressional mandates of the Safe Drinking Water Acts of 1986. The author presents four reasons why primacy should be retained. To preserve primacy, three changes must be made: 1) statutory changes to the SDWA, increased state money to fund primacy, and 3) increased state flexibility and discretion. The EPA has taken several steps to “buy time” for states to raise money and get their houses in order in order to maintain primacy: extensions on adopting drinking water regulations; establishing a priority-setting process so that states can adopt regulations in a specified order; and regulation “fixes” that would fix shortcomings in proposed regulations. However, these efforts are only temporary; to address the problem, there must be changes in the SDWA, and Congress must provide funding for states to meet its mandates.
