Description

This article outlines the need for and basic tenets of model legislation called the Drinking Water Protection Act. The purpose of the model legislation is to provide a model bill to help state legislators raise the funds required to support enforcement activities. This funding mechanism is needed because both the US Environmental Protection Agency and states that have primacy lack the funds necessary to enforce the regulations required by the Safe Drinking Water Act. The model legislation sets forth a mechanism for raising revenues based on so many cents per thousand gallons of water sold throughout the state, and each water system would be charged a Safe Drinking Water Enforcement Surcharge equal to that number of cents per thousand gallons sold. Appended to the paper is the full text of the Drinking Water Protection Act.
