Description
Various legal grounds for filing suite to recover the costs of cleanup of contaminated underground water supply sources are summarized. The author also outlines prudent measures that a plaintiff utility should take in preparing and presenting evidence. The issue of raising rates, and thus revenues, to meet the immediate costs of additional water treatment while pursuing financial assistance from the party responsible for the contamination is addressed briefly.
